Downloading Actionforge = agreeing to these terms. If you use this at work, your company, boss and co-workers are agreeing to play by these rules too.
By downloading, installing, accessing, or using the Actionforge software (including the Web App Editor, Runner Executable, and GitHub Action), you and any entity that you represent ("Licensee" or "you") are unconditionally consenting to be bound by this Agreement with [Your Company Name], a company registered in Quebec, Canada ("Licensor," "we," "us," or "our"). If you are executing this Agreement on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.
If you do not agree to these terms, do not download, install, access, or use the Software.

Indie devs and startups earning less than $500k/year? Actionforge is free to use.
Making over $500k? It's a 30-day trial, then a commercial license is required.
2.1 Conditional License Grant. Subject to the terms of this Agreement, Licensor grants to Licensee a non-exclusive license to install, access, use, and modify the Software solely for Licensee's internal business purposes or personal use, provided that Licensee's Gross Revenue does not exceed the Revenue Threshold.
2.2 Trial Period. Entities whose Gross Revenue exceeds the Revenue Threshold may use the Software under this license for a one-time trial period of thirty (30) calendar days.
2.3 Exceeding the Threshold. If Licensee's Gross Revenue exceeds the Revenue
Threshold:
(a) Licensee must notify Licensor within 30 days;
(b) Licensee may continue using the Software for up to 60 days to negotiate a Commercial
License;
(c) If no Commercial License is executed, this license terminates.
2.4 Modification Rights. Licensee may modify the Software for its internal use only.
No re-selling the tool in any shape or form.
Also, absolutely no using this for nuclear plants or illegal activities.
3.1 Prohibited Uses. Licensee will not:

Who owns what: The tool belongs to the creator; everything built with it belongs to you.
Feedback provided? It can be used to improve the product freely. No gatekeeping.
4.1 Licensor's IP. Licensor retains all right, title, and interest in and to the Software.
4.2 Licensee Data. Licensee retains all right, title, and interest in and to the visual graphs, workflows, pipelines, and content created by Licensee ("Licensee Data").
4.3 Feedback. Licensee grants Licensor a perpetual, irrevocable, royalty-free license to use any Feedback provided.
Trust is key. But if you look like a giant corporation on the free tier for months, I come over and take your keyboard and mouse away. Play fair.
5.1 Self-Certification. Licensee agrees to provide written certification of Gross Revenue upon request (max once per year).
5.2 Audit Rights. Licensor may engage a third-party auditor upon 30 days' notice to verify compliance with the Revenue Threshold.
5.4 Audit Costs. If Licensee has exceeded the threshold by >5%, Licensee pays for the audit. Otherwise, Licensor pays.
Don't spill the tea. I keep your secrets, you keep mine.
6.1 Obligations. Receiving Party agrees to maintain Proprietary Information in strict confidence and not disclose it to third parties without consent.
6.3 Survival. Obligations survive termination for 3 years.
Tools like PostHog help me track anonymous usage stats and crash reports.
There is no collection of PII. I just want to know how features are used, and what I need to improve or fix.
7.1 Telemetry Collection. Licensor may collect anonymous technical data ("Telemetry") to improve and debug the Software.
7.2 No PII. Licensor warrants that Telemetry does not intentionally include Personally Identifiable Information (PII) or Licensee's proprietary code logic.
7.5 Opt-Out. Licensee may disable Telemetry by following instructions in the Documentation.
Updates are free, but not guaranteed. Formal support isn't part of the free tier.
8.1 Updates. Licensor may provide updates at its discretion. Updates are subject to this Agreement.
8.4 Support. Licensor provides community-based support. Licensor has no obligation to provide formal technical support under this license.
The software is provided "AS-IS". If the pipeline breaks, that's unfortunate, but not on me.
The software is provided "as-is" and "as available," without any warranties of any kind.
To the maximum extent permitted by applicable law, Licensor disclaims all warranties, including merchantability and fitness for a particular purpose.
The Cap: In the unlikely event of a lawsuit, the max payout is $10 USD (or whatever you paid). For free users, it's $0.
Lost data or profits are not covered.
10.1 Exclusion of Damages. In no event will Licensor be liable for indirect, incidental, special, or consequential damages (including lost profits or data).
10.2 Liability Cap. Licensor's total liability will not exceed the greater of: (i) $100 USD, or (ii) Fees paid by licensee in the preceding 12 months.
Doing illegal stuff with the tool that causes a lawsuit? Please don't be that person!
11.1 Indemnification by Licensee. Licensee agrees to indemnify and hold harmless Licensor from any claims arising out of Licensee's use or misuse of the Software, violation of this Agreement, or infringement of third-party rights.
Made in Canada. 🇨🇦 Don't use this software in sanctioned countries.
Licensee will not export the Software to any country prohibited by applicable export control laws (including Canadian or international sanctions).
Ghosting: Quit anytime by deleting the app.
If you break the rules, consider the license revoked immediately.
13.2 By Licensee. Licensee may terminate at any time by ceasing use and destroying copies.
13.3 By Licensor for Cause. Licensor may terminate immediately if Licensee breaches a material term (including exceeding Revenue Threshold without paying).
13.5 Effect. Upon termination, Licensee must immediately cease all use and delete the Software.
Home Court: Any legal drama happens here in Montreal, Quebec. Canadian law rules.
14.1 Governing Law. Governed by the laws of Quebec and Canada.
14.2 Venue. Courts in Montreal, Quebec have exclusive jurisdiction.
14.3 Negotiation. Parties agree to attempt good faith negotiation before legal proceedings.
15.1 Entire Agreement. This is the whole deal.
15.2 Amendments. The terms can change over time.
15.13 Language. The parties confirm their express wish that this Agreement be drawn up in English. Les parties confirment leur volonté expresse que cette convention soit rédigée en anglais.
